These General Terms and Conditions of Sale apply when you place an order with the seller "Annette Petavy Design" on its website.

Annette Petavy Design (APD)'s main activity is the sale of products dedicated to the art of crochet and knitting.

APD markets explanatory sheets, entirely designed and produced by independent knitwear designers.

In addition, APD sells books, accessories and threads.

If certain products are no longer available for sale, they will be immediately removed from the Annette Petavy Design website.

ARTICLE 1 - Product characteristics

The explanatory sheets marketed by the Company Annette Petavy Design are original creations, protected by intellectual property law.

ARTICLE 2 - Orders

2.1 Order process

In accordance with article 1369-4 1° of the civil code, here is the order description:

Select the desired product, by clicking on its title or on its photo, select the quantity if necessary, then click on "Add to basket".

As soon as you wish to finalize your order, click on “Basket”.

You then have the opportunity to modify or confirm your order (article 1369-4 2° civil code), then validate it by clicking on “Next”.

You are then redirected to a page where you can create your customer account or connect to it, and if necessary a registration form, which you must fill in correctly. The boxes marked with an asterisk must be completed.

You are then invited to pay for your order on the Paypal payment platform, to this end click on “Continue” and “Confirm”, after having carefully read and validated these general conditions of sale.

You are then invited to pay for your order.

The ordering process is complete.

2.2 Correct labels

The information you enter when placing an order is binding on you: in the event of an error in the wording of your contact details, Annette Petavy Design cannot be held responsible for the impossibility of delivering to you if you have incorrectly filled in the order form. registration.

2.3 Order Confirmation

As soon as your order is registered, an order number is communicated to the customer as well as a confirmation on the screen and by e-mail.

The data recorded by Annette Petavy Design constitutes proof of the nature, content and date of the order.

Annette Petavy Design confirms the acceptance of her order to the customer at the e-mail address that the latter will have communicated. The sale will only be concluded once the order has been confirmed.

If the products ordered are unavailable on delivery, the professional seller immediately informs the consumer and may offer him a product of equivalent quality and price.

In case of disagreement, the consumer is reimbursed without delay (or at the latest within thirty days of payment of the sums paid).

Annette Petavy Design reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order which has not been resolved.

ARTICLE 3 - Rates

The products are supplied at the current prices appearing on the site, when the order is recorded by the seller. Prices are expressed in euros including tax.

Only the price in effect at the time of purchase is valid. In other words, if you subsequently notice an exceptional promotion on a product, you will not be able to benefit from it.

These prices do not include processing, shipping, transport and delivery costs, which are invoiced in addition, but the amount of which appears clearly when placing the order.

An invoice can be drawn up on request and delivered to the buyer upon delivery of the products ordered.

ARTICLE 4 - Terms of payment

The price is payable in cash, in full on the day the order is placed by the buyer, by means of secure payment, according to the following terms:

- Paypal secure payment (account or credit card)

- PayPlug secure payment (credit card)

- bank transfer or check, on specific request

The Paypal site is equipped with an online payment security system allowing the consumer to encrypt the transmission of his bank details.

Payments made by the buyer will only be considered final after full payment and the products can only be shipped after actual collection of the sums due by the seller.

ARTICLE 5 - Deliveries

The products acquired by the buyer will be delivered in metropolitan France, Corsica and Monaco within 30 working days; for the DOM/TOM, the European Union and international, this period is 3 months.

The order is delivered to the address indicated by the buyer when ordering on the website. Except in special cases or unavailability of one or more products, the products ordered will be delivered in one go.

In accordance with Article L.121-20-3 of the Consumer Code, in the event of non-compliance with this deadline, the consumer can obtain the resolution of the sale if this delay in delivery is not due to a case of force majeure.

The consumer may, within sixty working days from the date of delivery indicated, cancel his order by registered letter with acknowledgment of receipt, or return the products at his own expense if they have been delivered and will receive from the seller at the latest within thirty days the return of his payment, excluding any compensation.

Delivery is deemed to have been made upon delivery of the products ordered by the seller to the carrier.

We ask that you check the status of orders upon receipt.

The carriers available are La Poste or Mondial Relay (for metropolitan France, Belgium and Luxembourg only).

Participation in shipping costs for delivery by La Poste is €5.90 for deliveries in mainland France, Corsica and Monaco, €11.80 for overseas departments and territories, €14.90 for European Union outside France + Switzerland and €23.50 for the rest of the world.

Free shipping for mainland France only from €75.00 of purchases excluding downloadable products.

Participation in the shipping costs for a delivery by Mondial Relay is €5.00 for deliveries in mainland France, €5.10 for deliveries in Belgium and Luxembourg, and €5.90 for deliveries in Spain . Free shipping from €75.00 of purchases excluding downloadable products for Metropolitan France, Belgium and Luxembourg only.

Books may, because of their weight, be subject to specific pricing, corresponding to the actual shipping costs. This price is detailed on the product page.

Products exceeding 3 cm thick including packaging are sent by Colissimo without signature in Metropolitan France and the DOM - TOM and by Colissimo without signature for the rest of the world, except delivery by Mondial Relay.

In the event of a special request from the buyer concerning the conditions of packaging or transport of the products ordered, duly accepted in writing by the seller, the related costs will be the subject of additional specific invoicing, on an estimate previously accepted by written by the buyer.

In accordance with article L.121-20-3, in the event of non-execution of the order resulting from the unavailability of the goods ordered, the consumer will be informed of this unavailability and will be reimbursed without delay and at the latest within thirty days of payment of the sums he has paid. The supplier may provide goods of equivalent quality and price with the buyer's agreement.

ARTICLE 6 - Transfer of ownership - Transfer of risks

Return costs are the responsibility of the buyer.

The seller undertakes to reimburse the buyer at the latest within thirty days following the date on which the right of withdrawal was exercised, provided that the returned products are in their original packaging, complete and in in a perfect state.

However, in accordance with Article L121-20-3 6° of the Consumer Code, this right cannot be exercised for goods that can be immediately read by the consumer. Thus, the explanatory sheets (which can be immediately downloaded by the buyer) cannot be the subject of such a right.

ARTICLE 8 - Liability of the Seller

Legal Guarantee

The products supplied by the seller benefit, in accordance with the legal provisions,

- the legal guarantee of conformity,

- the legal guarantee against hidden defects resulting from a material, design or manufacturing defect affecting the products delivered and rendering them unfit for use.

In other words, if the good received does not correspond to the order, or if it has a hidden defect, the customer is entitled to return it for reimbursement.

Return costs are the responsibility of the seller

Any warranty is excluded in the event of misuse, negligence or lack of maintenance on the part of the buyer, as in the event of normal wear and tear of the property, accident or force majeure and the seller's warranty is limited to replacement or reimbursement of non-compliant products or products affected by a defect.

The buyer is solely responsible for the choice of products, their conservation and their use.

In order to assert your rights, you must inform the seller, in writing, of the existence of the defects or the lack of conformity within a maximum period of 2 years from their discovery, or a period of 2 years from the purchase for nonconforming goods.

The seller will replace defective or non-conforming products.

The products sold on the website comply with the regulations in force in France.

The seller will not be considered responsible or in default for any delay or non-performance resulting from the occurrence of a case of force majeure usually recognized by French case law.

ARTICLE 9 - IT and Freedoms

Annette Petavy Design records all past transactions on her site, they allow you to constitute proof of all your purchases.

In application of law 78-17 of January 6, 1978, it is recalled that the personal data which are requested from the buyer are necessary for the processing of his order and the establishment of invoices.

The processing of information communicated through the seller's site has been declared to the CNIL under number 1574658.

The buyer has, in accordance with the national and European regulations in force, a right of permanent access, modification, rectification and opposition with regard to information concerning him.

ARTICLE 10 - Intellectual property

The content of the site, in particular the graphic charter, the logo, the photos, the products, are the property of the seller and its partners and are protected by French and international laws relating to intellectual property.

Any total or partial reproduction of this content and products is strictly prohibited and is likely to constitute an offense of counterfeiting.

Consequently, the client is therefore prohibited from any reproduction or use of the said creations without the express, written and prior authorization of APD, which may condition it on financial compensation.

The explanatory sheets sold by APD are protected by copyright, so buyers cannot post them on social networks, their blog, or elsewhere on the Internet, nor resell them.

ARTICLE 11 - Applicable law - Language

By express agreement between the parties, this contract is governed by and subject to French law.

It is written in French. In the event that it is translated into one or more languages, only the French text shall prevail in the event of a dispute.

ARTICLE 12 – Disputes

In order to prevent possible disputes, Annette Petavy Design will put into service a "customer service", a telephone line at the following number: 06 62 50 55 35, which can be reached between 9 am and 5 pm from Monday to Friday.

Each customer request will be processed as soon as possible and we will try to provide the most appropriate response.

ARTICLE 13 - Archiving

Any contract entered into with the customer corresponding to an order for an amount greater than €120 including tax will be archived by APD for a period of 10 years. To access the archived contract that he has subscribed to, the client must make a request to Annette Petavy Design by e-mail followed by a registered letter with acknowledgment of receipt.

The contract will be archived on a database owned by Annette Petavy Design.
